Welcome to the Niche Discovery Engine (the “Tool”) provided by **Creator Tools** (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the AI-powered niche recommendation tool available at **https://hokumanu.com/niche-discovery-demo** and related Pro version.

By accessing or using the Tool, you agree to be bound by these Terms. If you disagree with any part, you may not use the Tool.

### **1. Description of Service**

The Niche Discovery Engine is an interactive tool designed to help creators, entrepreneurs, and content makers explore potential business or content niches. Through a guided, 10-question diagnostic, the Tool uses artificial intelligence (AI) to analyze your responses and suggest personalized niche directions and actionable insights.

We offer two access tiers:
– **Free Tier:** Limited to 3 diagnostic sessions per user per monthly billing cycle.
– **Paid/Pro Tier:** Provides up to 50 diagnostic sessions per user per monthly billing cycle, along with more detailed AI analysis. Access is granted through an active subscription via our Patreon page.

### **2. User Obligations & Acceptable Use**

You agree to use the Tool lawfully and only for its intended purpose of self-discovery and creative brainstorming. You are responsible for all content you submit through the Tool (“User Content”).

You agree **NOT** to:
– Submit false, misleading, or harmful information.
– Attempt to reverse-engineer, decompile, or extract the source code of the Tool.
– Use automated systems (e.g., bots, scrapers) to access the Tool or generate sessions beyond your tier’s limit.
– Use the Tool to generate content that is abusive, fraudulent, infringing, obscene, or violates any third-party rights.
– Share your Patreon-gated access with others to circumvent usage limits.

### **3. Intellectual Property Rights**

– **Our IP:** The Tool, its underlying software, design, functionality, and all content we provide (except your User Content) are the property of Creator Tools and its licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the Tool.
– **Your IP:** You retain ownership of the original User Content (your answers) you submit. However, by submitting User Content, you grant us a worldwide, royalty-free license to process that content solely to provide the Tool’s analysis service (e.g., sending it to the AI model to generate your report).
– **AI Output:** The niche suggestions, analysis, and reports generated by the AI (“Output”) are provided for your personal, informational use. We do not claim ownership over the Output, but you may not resell, license, or repackage the core Output as a standalone service or product that directly competes with the Niche Discovery Engine.

### **4. Disclaimers & Limitation of Liability**

– **Tool “As Is”:** The Tool and its AI-generated Output are provided for **informational and brainstorming purposes only**. They are not professional business, financial, legal, or career advice. You are solely responsible for any decisions or actions you take based on the Tool’s suggestions.
– **No Guarantee of Results:** We do not guarantee the accuracy, completeness, suitability, or success of any niche suggestion. The AI analysis is based on patterns in your input and should be treated as one of many creative inputs for your decision-making.
– **Limitation of Liability:** To the fullest extent permitted by law, Creator Tools and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Tool or reliance on its Output.

### **5. Privacy & Data Handling**

Your privacy is important. Our data practices are detailed in our separate **Privacy Policy**. In using the Tool, you acknowledge that:
– We collect and process your diagnostic answers (User Content) to generate your personalized report.
– We use third-party AI services (currently DeepSeek) to process this data. The AI provider’s own privacy terms apply to their processing.
– We store your session data (questions, answers, and AI analysis) in our database to provide the export function and manage your usage limits.
– We do not sell your personal data or diagnostic answers to third parties for marketing or training unrelated AI models.

### **6. Paid Tier & Subscriptions**

Access to the Pro Tier is managed through a subscription via **Patreon**. Your access is subject to:
– Maintaining an active subscription to the specified Creator Tools tier on Patreon.
– Our integration with Patreon’s OAuth system to verify your subscription status.
– **Monthly Session Reset:** Your usage counter (e.g., 3/50 sessions used) resets on the first calendar day of each month, regardless of your Patreon billing date.
– We reserve the right to modify subscription fees, features, or session limits with reasonable notice.

### **7. Termination**

We may suspend or terminate your access to the Tool immediately if you breach these Terms. You may stop using the Tool at any time.

### **8. Modifications to Terms**

We may update these Terms occasionally. We will post the updated Terms on the Tool’s website with a new “Last Updated” date. Your continued use of the Tool after changes constitutes acceptance.
